Welcome to Aggressively Mediocre. These Terms of Service ("Terms") govern your use of our website at shop.aggressivelymediocre.com (the "Site") and any purchase you make from us. Aggressively Mediocre is a sole proprietorship based in Fallbrook, California, USA ("we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site. We promise the products are more fun than this page.

**1. Eligibility**

You must be at least the age of majority where you live, or use the Site with the involvement of a parent or guardian, to place an order. You agree to provide accurate, current and complete information when you make a purchase, including your shipping address and email.

**2. Our products**

- All products are made to order and fulfilled by our third-party print-on-demand partner, Printful.
- We try to display product colors, designs and details as accurately as possible, but your screen may not show them exactly, and small variations in color, print placement and sizing are normal for printed products.
- Sizes are approximate; please check the size chart on each product page before ordering.
- Our designs are humorous and intended for entertainment. Wearing them does not guarantee mediocrity, nor exempt you from it.

**3. Orders, pricing and payment**

- All prices are listed in US dollars (USD) and may change at any time without notice. Price changes don't affect orders already placed.
- Your order is an offer to buy. We may accept, refuse or cancel any order at our discretion, for example if a product is unavailable, there's a pricing or listing error, or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full.
- Payments are processed securely through Shopify and its payment partners. You agree that the payment information you provide is valid and that you're authorized to use it.
- Applicable sales taxes are calculated at checkout. International customers may owe import duties or taxes, as described in our Shipping Policy.

**4. Shipping, returns and refunds**

Shipping is covered by our Shipping Policy, and returns, replacements, cancellations and refunds are covered by our Refund Policy. Both are part of these Terms. In short: because items are custom-made, we don't accept returns for change of mind or wrong size, but we'll replace or refund defective, misprinted, damaged or incorrect items reported within 30 days of delivery.

**5. Intellectual property**

All content on the Site, including our designs, slogans, logos, graphics, text and images, is owned by or licensed to Aggressively Mediocre and is protected by copyright, trademark and other laws. Buying a product gives you the right to own and use that physical item. It does not give you the right to copy, reproduce, resell the designs, or use our name or logo for commercial purposes without our written permission.

**6. Acceptable use**

You agree not to use the Site to: break any law; infringe anyone's rights; submit false or misleading information; upload viruses or malicious code; scrape, interfere with or disrupt the Site or its security; or harass, abuse or impersonate others. We may suspend or block access for anyone who violates these Terms.

**7. Reviews, comments and submissions**

If you post a review, comment or other content on the Site or send us feedback, you grant us a non-exclusive, royalty-free, worldwide license to use, display and share it in connection with our business. You're responsible for what you submit, and it must not be unlawful, offensive, defamatory or infringing. We may remove any submission at our discretion.

**8. Third-party services and links**

The Site is hosted on Shopify, and orders are produced and shipped by Printful and their carrier partners. The Site may also link to third-party websites. We aren't responsible for third-party websites, services or content, and your use of them is subject to their own terms and policies.

How we collect and use your personal information is described in our Privacy Policy.

**10. Disclaimer of warranties**

Except as expressly stated in our Refund Policy and to the fullest extent permitted by law, the Site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Site will be uninterrupted, error-free or secure. Some jurisdictions don't allow certain warranty exclusions, so some of these may not apply to you.

**11. Limitation of liability**

To the fullest extent permitted by law, Aggressively Mediocre and its owner will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of your use of the Site or any product. Our total liability for any claim relating to a product or order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.

**12. Indemnification**

You agree to indemnify and hold harmless Aggressively Mediocre and its owner from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.

**13. Governing law**

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. If you are a consumer living outside the United States, you may also have the benefit of mandatory consumer protection laws of your country of residence.

**14. Changes to these Terms**

We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date above will change. Continuing to use the Site after changes are posted means you accept the updated Terms. The Terms in effect when you place an order apply to that order.

**15. Severability and entire agreement**

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Refund Policy, Shipping Policy and Privacy Policy, are the entire agreement between you and us about the Site and your purchases.
